These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you,” “your,” or “User”) and GarageHero LLC, a New Jersey limited liability company (“GarageHero,” “Company,” “we,” “us,” or “our”), governing your access to and use of the GarageHero mobile application, the website located at garagehero.io, and all related features, content, and services (collectively, the “Service” or the “Platform”).
By accessing, browsing, or using the Platform in any manner—including by creating an account, listing a space, making a reservation, or otherwise utilizing any feature of the Service—you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must discontinue all use of the Platform.
1. The GarageHero Platform
GarageHero is a peer-to-peer marketplace that connects individuals seeking parking (“Drivers”) with property owners who make parking spaces available for rent (“Hosts”). GarageHero is an intermediary platform only. We do not own, operate, inspect, manage, or control any parking space, and we are not a party to any rental arrangement between a Host and a Driver. We are not the agent or representative of any Host or Driver, and we do not act as a parking operator, real estate broker, or insurer. Any agreement formed in connection with a booking is entered into directly and exclusively between the Host and the Driver.
2. Eligibility
You must be at least eighteen (18) years of age and capable of forming a legally binding contract to access or use the Platform. By using the Service, you represent and warrant that you meet these requirements, that all information you provide is accurate and complete, and that your use of the Platform does not violate any applicable law or regulation. We reserve the right to request proof of age or identity and to deny access to any person who fails to meet these eligibility requirements.
3. Accounts and Account Security
To access certain features of the Platform, you must register for an account and provide accurate, current, and complete information. You are solely responsible for safeguarding your account credentials and for all activity that occurs under your account. You agree to notify us promptly at [email protected] of any unauthorized use of your account or any other breach of security. GarageHero will not be liable for any loss or damage arising from your failure to protect your credentials. You agree to keep your account information accurate and up to date at all times.
4. Bookings, Fees, and Payments
- Payment processing. All payments are processed through our third-party payment processor, Stripe. By making or receiving payments through the Platform, you agree to Stripe’s applicable terms and authorize GarageHero and Stripe to process the relevant amounts. GarageHero does not store your full payment card or bank account numbers on its own servers.
- Service fee and commission. Hosts receive ninety percent (90%) of each booking amount, and GarageHero retains a ten percent (10%) platform fee. GarageHero reserves the right to modify its fee structure upon reasonable notice, with any change applying to bookings made after the change takes effect.
- Taxes. Where required, GarageHero collects and remits applicable sales tax in its capacity as a marketplace facilitator. Hosts remain solely responsible for reporting their rental income and for any other taxes applicable to their activities.
- Payouts. Host payouts are disbursed through Stripe to the payout method the Host designates, subject to Stripe’s processing timelines.
- Payment authorization. By completing a booking, you authorize GarageHero to charge your designated payment method for the total amount displayed at checkout, including the booking subtotal, service fee, and any applicable tax.
5. Cancellations and Refunds
The GarageHero renter service fee is nonrefundable when a Driver cancels. All refund percentages set forth below apply solely to the eligible (refundable) booking amount and not to the service fee. Any sales tax associated with a refunded booking amount will be reversed in proportion to the amount refunded.
5.1 Driver Cancellations — Hourly Bookings
- Seven (7) or more days before the booking: full refund of the eligible booking amount, less the service fee.
- Three (3) to seven (7) days before the booking: fifty percent (50%) refund of the eligible booking amount, less the service fee.
- Less than three (3) days before the booking: no refund.
- No-show: no refund.
5.2 Driver Cancellations — Daily Bookings
- Seven (7) or more days before the booking: full refund of the eligible booking amount, less the service fee.
- Three (3) to seven (7) days before the booking: fifty percent (50%) refund of the eligible booking amount, less the service fee.
- Two (2) to three (3) days before the booking: twenty-five percent (25%) refund of the eligible booking amount, less the service fee.
- Less than two (2) days before the booking: no refund.
- No-show: no refund.
5.3 Host Cancellations
If a Host cancels a confirmed booking, the Driver is not penalized and will receive a full refund to the original payment method, including the booking subtotal, the renter service fee, and any applicable sales tax. To cover payment-processing costs and the disruption caused to the Driver, the cancelling Host will be charged twelve percent (12%) of the Driver’s total payment plus a payment-processing fee of $2.50. For purposes of this section, the Driver’s total payment means the complete amount charged at checkout, including the booking price, service fee, and tax. A Host cancellation is finalized only once the Host’s cancellation charge has been successfully processed; if that charge fails, the booking remains active and the Driver is not refunded until the cancellation is completed.
6. Host Obligations and Representations
By creating a listing, each Host represents, warrants, and agrees that:
- The Host holds the legal right, authority, and all necessary permissions to list and rent the space, including any consent required from property owners, landlords, homeowner or condominium associations, or applicable municipal authorities;
- All listing information—including location, availability, dimensions, pricing, and access instructions—is accurate, complete, and not misleading;
- The space conforms to its listing description and is safe and accessible for its intended use throughout each booked period;
- The Host will honor all confirmed bookings and comply with all applicable local, state, and federal laws, ordinances, and zoning requirements; and
- The Host is solely responsible for obtaining any insurance appropriate to the rental of the space and for determining and remitting any taxes applicable to the Host’s income.
7. Driver Obligations and Representations
By making a booking, each Driver represents, warrants, and agrees that:
- The Driver will park only in the space reserved, during the reserved period, and will vacate the space by the end of that period;
- The Driver will comply with all listing rules, access instructions, and property-specific requirements provided by the Host;
- The Driver will treat the Host’s property with respect and will be responsible for any damage the Driver causes to the space or surrounding property; and
- The Driver’s booking is for personal use only and will not be resold, transferred, or assigned to any third party.
8. Prohibited Conduct
You agree that you will not, and will not assist or permit any third party to: use the Platform for any unlawful, fraudulent, or unauthorized purpose; post false, misleading, or fraudulent information; infringe the rights of any other person; circumvent GarageHero to arrange or pay for bookings outside the Platform; harass, threaten, or harm any other User; interfere with or compromise the security or integrity of the Platform; or use automated means to access or extract data from the Platform without our prior written consent.
9. Disclaimers
The Platform and all services, content, and functionality are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, to the fullest extent permitted by applicable law.
GarageHero is a marketplace only. We do not own, operate, inspect, or control any parking space, and we do not verify every statement made by Hosts or Drivers. We make no representation or warranty that any space will be available, safe, lawful, accurately described, or free from disputes, and we do not guarantee the conduct of any Host or Driver, nor that the Platform will be uninterrupted, secure, or error-free. To the maximum extent permitted by law, GarageHero disclaims all liability for any act or omission of any Host, Driver, or other User, and for any matter relating to any parking space, listing, or booking, including property damage, vehicle damage, theft, personal injury, towing, fines, or trespass. You acknowledge that, to the maximum extent permitted by law, you assume the entire risk arising from your use of the Platform, your use of any parking space, and any contact you have with other Users.
10. Insurance
GarageHero does not provide insurance of any kind to any User at any time. This includes, without limitation, vehicle insurance, property-damage insurance, theft coverage, and liability insurance. Hosts are solely responsible for obtaining and maintaining any insurance appropriate for renting out their space, including property and liability coverage, and we strongly recommend that Hosts consult their insurance provider before listing any space. Drivers are responsible for maintaining their own vehicle insurance. In the event of theft of or damage to a vehicle or its contents, you must contact the police and your own insurance provider; GarageHero bears no responsibility or liability for theft of, or damage to, any vehicle, property, or stored items.
11. Limitation of Liability
To the fullest extent permitted by law, GarageHero and its owners, members, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, vehicles, or property, arising out of or relating to your use of the Platform, whether based in contract, tort (including negligence), strict liability, or any other theory, and regardless of whether we have been advised of the possibility of such damages. In no event will the aggregate liability of GarageHero arising out of or relating to these Terms or your use of the Platform exceed the greater of (a) the total platform fees you paid to GarageHero in the six (6) months preceding the event giving rise to the claim, or (b) one hundred dollars ($100.00).
GarageHero will not be liable for any delay or failure to perform resulting from causes beyond its reasonable control, including acts of God, natural disasters, epidemics or pandemics, war, terrorism, riots, labor disputes, power or telecommunications failures, or governmental action.
Certain jurisdictions do not permit the exclusion of specific warranties or the limitation of certain damages, so portions of the foregoing may not apply to you. If you are a New Jersey user, the “Disclaimers” and “Limitation of Liability” sections apply only to the fullest extent permitted by New Jersey law, and nothing in these Terms is intended to disclaim liability that cannot lawfully be disclaimed, including liability for fraud, gross negligence, or intentional misconduct.
12. Indemnification
You agree to indemnify, defend, and hold harmless GarageHero and its owners, members, employees, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: your use of, or inability to use, the Platform; your listings or bookings; any dispute between you and another User; your violation of these Terms or any applicable law; your violation of the rights of any third party; any property damage, personal injury, or other harm arising from your use of any space; and your use of the Platform while operating a motor vehicle. GarageHero reserves the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with such defense.
13. Dispute Resolution; Arbitration and Class Action Waiver
Please read this section carefully, as it affects your legal rights. To the fullest extent permitted by law, you and GarageHero agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Platform will be resolved by binding individual arbitration rather than in court, except that either party may (a) bring a qualifying claim in small claims court, or (b) seek emergency equitable relief to prevent irreparable harm.
Class action waiver. You and GarageHero agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person’s claims or preside over any form of class or representative proceeding. If this class action waiver is found to be unenforceable, the entirety of this arbitration agreement will be null and void.
Opt-out. You may opt out of this arbitration agreement by sending written notice to [email protected] within thirty (30) days of first accepting these Terms, stating your name, mailing address, and a clear statement of your intent to opt out. If you opt out, the remaining provisions of these Terms will continue to apply.
14. Time Limitation on Claims
Any claim or cause of action arising out of or relating to these Terms or your use of the Platform must be commenced within one (1) year after the claim or cause of action arose; otherwise, it is permanently barred, to the extent permitted by applicable law, regardless of whether the claim is based in contract, tort, statute, or any other legal theory.
15. Suspension and Termination
You may discontinue using the Platform and request deletion of your account at any time, subject to any outstanding bookings, payments, disputes, chargebacks, claims, or other obligations.
GarageHero may suspend, restrict, deactivate, or terminate your account or access to the Platform; remove or disable a listing; cancel a booking; or limit your ability to send or receive payments if we reasonably believe that:
- You violated these Terms or any applicable law;
- Information associated with your account or listing is false, incomplete, misleading, or fraudulent;
- Your activity creates a safety, security, financial, legal, or reputational risk;
- You failed to pay an amount owed to GarageHero or another User;
- You engaged in abusive, threatening, discriminatory, or otherwise inappropriate conduct;
- A payment, chargeback, refund, dispute, investigation, or law-enforcement request requires such action; or
- Suspension or termination is necessary to protect GarageHero, another User, a third party, or the integrity of the Platform.
Where reasonably practicable, GarageHero may provide notice of the suspension or termination and an opportunity to address the issue. However, we are not required to provide advance notice when immediate action is reasonably necessary for safety, fraud prevention, legal compliance, or protection of the Platform.
Suspension or termination does not relieve you of any obligation incurred before the effective date of the suspension or termination. GarageHero may retain amounts otherwise payable to a User when reasonably necessary to address refunds, chargebacks, claims, damages, penalties, unpaid fees, or other amounts owed, to the extent permitted by law and Stripe’s applicable terms.
Upon termination, your limited right to use the Platform immediately ends. Provisions that by their nature should survive termination—including provisions concerning payments, refunds, intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and outstanding obligations—will remain in effect.
16. User Content
The Platform may allow Users to submit or upload listing descriptions, photographs, reviews, ratings, messages, access instructions, profile information, and other material collectively referred to as “User Content.”
You retain ownership of your User Content. By submitting User Content through the Platform, you grant GarageHero a nonexclusive, worldwide, royalty-free license to host, store, reproduce, display, format, adapt, and distribute that content solely as reasonably necessary to operate, improve, secure, and promote the Platform and your listing.
You represent and warrant that:
- You own or have all rights and permissions necessary to submit the User Content;
- The User Content is accurate and not misleading;
- The User Content does not violate any law, contract, privacy right, intellectual-property right, or other right of any person; and
- The User Content does not contain unlawful, threatening, discriminatory, defamatory, obscene, fraudulent, or malicious material.
GarageHero may remove, restrict, or decline to display User Content that violates these Terms, creates a safety or legal risk, or is otherwise inappropriate for the Platform.
Nothing in these Terms prevents a User from sharing an honest review, opinion, or account of the User’s experience. GarageHero does not claim ownership of a User’s review or penalize a User merely for posting an honest negative review. Federal law limits provisions in consumer form contracts that prohibit honest reviews, impose penalties for them, or require consumers to transfer ownership of their reviews.
17. Intellectual Property
Except for User Content, the Platform and all materials made available through it—including the GarageHero name, logos, trademarks, designs, software, text, graphics, icons, interfaces, databases, and compilation of content—are owned by or licensed to GarageHero and are protected by applicable intellectual-property laws.
Subject to your compliance with these Terms, GarageHero grants you a limited, personal, revocable, nonexclusive, nontransferable license to access and use the Platform solely for its intended purposes.
You may not, without GarageHero’s prior written permission:
- Copy, modify, distribute, sell, lease, sublicense, or commercially exploit any portion of the Platform;
- Reverse engineer, decompile, disassemble, or attempt to obtain the source code of the Platform, except where such restriction is prohibited by law;
- Remove or alter copyright, trademark, or proprietary notices;
- Use GarageHero’s name, branding, or content in a manner suggesting sponsorship, affiliation, or endorsement; or
- Create a competing service using information obtained through the Platform.
18. Electronic Communications
By creating an account or using the Platform, you consent to receive communications from GarageHero electronically, including through email, push notifications, in-app messages, and other contact methods you provide.
Electronic communications may include booking confirmations, payment and payout information, cancellation notices, access instructions, security alerts, policy updates, and other transactional or administrative messages.
You may opt out of promotional communications by using the unsubscribe option provided in the communication. Opting out of promotional messages will not prevent GarageHero from sending transactional, security, legal, or account-related communications.
You are responsible for keeping your email address and other contact information accurate and for reviewing communications sent to you through the Platform.
19. Third-Party Services
The Platform may rely on or link to third-party products and services, including Stripe, mapping providers, identity-verification providers, Apple’s App Store, and Google Play.
GarageHero does not control and is not responsible for the availability, accuracy, security, practices, terms, or content of third-party services. Your use of those services may be governed by separate agreements between you and the applicable third party.
GarageHero is not responsible for delays, failures, losses, or errors caused by a third-party provider, except to the extent that responsibility cannot lawfully be excluded.
20. Privacy
GarageHero’s collection, use, storage, and disclosure of personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference.
By using the Platform, you acknowledge that you have reviewed the Privacy Policy and understand how GarageHero handles information associated with your account, listings, bookings, payments, communications, and use of the Platform.
21. Changes to the Platform or These Terms
GarageHero may modify, suspend, discontinue, or introduce features of the Platform at any time.
We may also update these Terms to reflect changes to the Platform, our business practices, applicable law, payment processing, safety requirements, or other operational needs.
When we make a material change, we will provide reasonable notice through the Platform, by email, or by another appropriate method. The updated Terms will identify the date on which they became effective.
Unless otherwise stated, changes will apply prospectively. Your continued use of the Platform after the effective date of updated Terms constitutes acceptance of those updated Terms. If you do not agree to an update, you must discontinue using the Platform.
Changes to fees, cancellation policies, or booking terms will not retroactively alter a booking that was already confirmed unless the change is required by law or agreed to by the affected Users.
22. Governing Law and Venue
These Terms and any dispute arising out of or relating to them or the Platform will be governed by the laws of the State of New Jersey, without regard to its conflict-of-law principles.
The Federal Arbitration Act will govern the interpretation and enforcement of the arbitration agreement in Section 13 where applicable.
For any claim that is not required to be arbitrated, you and GarageHero consent to the jurisdiction of a court of competent jurisdiction located in New Jersey, except where applicable consumer law permits or requires the claim to be brought elsewhere.
Nothing in these Terms eliminates any nonwaivable rights or remedies available under applicable federal, state, or local law.
23. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in full force and effect.
If any portion of the arbitration or class-action-waiver provisions is found unenforceable, the effect of that determination will be governed by Section 13.
24. Waiver
GarageHero’s failure or delay in exercising any right or enforcing any provision of these Terms does not constitute a waiver of that right or provision.
A waiver will be effective only if it is in writing and authorized by GarageHero. A waiver on one occasion will not constitute a waiver on any other occasion.
25. Assignment
You may not assign or transfer your account, these Terms, or any rights or obligations under these Terms without GarageHero’s prior written consent.
GarageHero may assign or transfer these Terms in connection with a merger, acquisition, financing, corporate reorganization, sale of assets, or transfer of the Platform, subject to applicable law.
26. No Partnership or Agency
Nothing in these Terms creates a partnership, joint venture, employment relationship, franchise, fiduciary relationship, or agency relationship between GarageHero and any User.
Hosts and Drivers act independently and are not authorized to make representations, commitments, or agreements on behalf of GarageHero.
27. Entire Agreement
These Terms, the Privacy Policy, the cancellation policy displayed during checkout, and any additional policies or terms expressly incorporated by reference constitute the entire agreement between you and GarageHero regarding the Platform.
They supersede any prior or contemporaneous agreements, statements, representations, or communications concerning the same subject matter.
If an additional written policy conflicts with these Terms, the more specific policy will control only with respect to the subject matter it addresses.
